Statue of limitatin in Shoplifting .

May5,2000 a friend of mine visiting California was involved in a shoplifting case.Dept store called the Police and she had to go to some sort of jail or a class for one day and paid some fines to the Police Dept.And she thought that was the end of the case. Now after 5 years attorneys of the Dept store are asking for another $525.oo for some sort of fees and if she does not pay they are threating to file a Lawsuit.Friend does not live in USA.

first of all, if your friend is not a US citizen and/or does not have residence in the US, then she would be out of the jurisdictional reach of any state's process serving long arm statute. thus, she cannot be reasonably hailed to court or properly served to appear. the case would have to be dismissed procedurally here. however, if this is a valid debt that she owes this creditor, it can be negatively reported to various credit bureaus, which could ultimately give her credit problems now and/or in the future. if she does not feel she owes this debt period, she may want to mail this company a legal validation of debt letter. if the company does not respond accordingly, then this debt must be discharged and/or removed from any of her credit reports if it is already there. if the company can validate the debt, your friend may want to pay it off in full or present a discounted settlement offer. if you would like further assistance, contact us today.
