Legal Question in Criminal Law in California

Statute of limitation when not arrainment

I was arrested in front of my mother's house when a cop stopped to ask me what I was doing coming out with boxes. I informed him that she had passed away and I was cleaning her house. He asked for my license, turned away and came back with something in plastic that he called meth. He then took my wallet, went into my car and searched my purse and car but didn't find anything. Was arrested and spent 36 hours in jail. Was let go with no arrainment or anything else. Has been over 5 months and I have not been able to get my wallet back because they say that the DA is reviewing the case for possible prosicution. How long does he get to charge me and with the way the cop acted was everything he did legal. I was not doing anything wrong for him to even stop much less arrest me. If they had taken a drug test they would have found that I was not on drugs. I am an almost 60 yr old great-grandmother, would I be starting now? What can I do to end all of this?

Re: Statute of limitation when not arrainment

Hi. Technically, they have a minimum of one year to file charges if it's a misdemeanor and a minimum of three years for most chareges if it's a felony. Feel free to give me a call to discuss your options.
