Statutory Rape & Age of Consent
My friend had sex with a 16 year old girl. He is 23. Her parents had him arrested for statutory rape and he is now in jail. My questions are:
1) What are the possible sentences for this crime?
2) Will he have to post bail?
3) Can this be treated as a misdemeanor? This is his
first offense.
4) How can he get a public defender?

Hello, the possible sentence for this crime is incarceration in a state prison. Yes, he will likely have to post bail. This scrime is a felony not a misdemeanor.
