Is it illeagal for a 15 year old and a 17 year old to have sex together?

CA penal code section 261.5 (b) makes it unlawful for to have sex with a minor (under 18) even if you are no more than 3 years older or younger than the victim. Yes it is illegal for both the 17 year old and 15 year old to engage in sexual activity.
