Statutory Rape Question

My girlfriend and I have been together for 2 years and I recently turned 18 while she is still 17, I was curious what laws apply to statutory rape in this case, because I have heard many different opinions. Thanks for any help

Re: Statutory Rape Question

The penal code does not refer to statutory rape, but refers to unlawful sexual intercourse. The statutory definition is set forth below.

261.5. (a) Unlawful sexual intercourse is an act of sexual

intercourse accomplished with a person who is not the spouse of the

perpetrator, if the person is a minor. For the purposes of this

section, a "minor" is a person under the age of 18 years and an

"adult" is a person who is at least 18 years of age.
