Legal Question in Criminal Law in California

stealing rent

my x-wife managed my brother's apartment building and I have discovered that she had tenants void rent checks written to my brother and re-written to her. She then cashed these checks into her account. How do I go about prosecuting her? What are the possible outcomes?

Re: stealing rent

Only the government can prosecute crimes. You couldn't prosecute even if you were the victim -- which, of course, you weren't. If you want, you can tell your brother what you know and let him decide whether to call the police and/or the D.A. Unless you want to risk getting him prosecuted too, you should first find out whether the checks that were originally made out to him should instead have been made out to his employer.

Part of my earlier response was based on a misreading of your question. I mistakenly believed your brother was not the owner of the building. My apologies for any resulting confustion.
