Legal Question in Criminal Law in California

my kid is 12 years old he got shoplifting at are local k mart they call me up i go down to pick him up he stole two little bottles of hand soap .so i told k mart i would pay for what ever he had taken and they said it was no more then 13 dollors they said no i would get letter in mail in awake or two .i get letter four days later they want me to pay $361.00 in 20 days there was no police called or nothing i think that that price is carzy i cant aford that at all . can they get away with that . i understand they cant put back on shelf or back in box and have to pay there security people to do there job i dont no why they didnt call police i know that when and adult gets cot for stelen somthing they call the cops and they go to jail could you please shed some light on this one for me thank you .

California law allows shopkeepers to charge those individuals caught shoplifting the costs they incur detaining them and processing the report. Most businesses charge the same fee for every case. You child is the one that was caught shoplifiting and should pay the charge. Send the store a letter stating that you son is looking for a job and when he has the money he will pay the bill.
