Legal Question in Criminal Law in California

Second strike for theft

My family member was charged with breaking and entering and petty theft with a prior in 1996, receiving his first strike and nearly 3 years in prison. He now has been arrested for petty theft with 2 priors, and the DA is giving his second strike. How long of a sentence can he expect if convicted?

Re: Second strike for theft

There are alot of slips and falls between being charged, and pleading or being convicted of a crime.

I believe that on a Second Strike they serve 70% of their sentence, and not the 50% (credit for good time work time) they normally serve.

However, there will be a lot of negotiations on this case and the D. A. has obviously over filed the case.
