Three strikes
If you are facing three strikes, does that make you ineligible for pc1000 if you meet all other criteria? Should the charge of simple possession HS11377 be classified as a misdemeanor if it you first ever drug charge?

If you are facing a three strikes sentence the drug charge is of no real consequence, and you would probably not be able to complete the required drug rehabilitation program in prison.
If you suffered convictions which would qualify as three strikes, you may not be elegible to drug diversion. You would have to have the judge strike the priors, if they are charged, to be eligible for diversion.

First, if you have never had a drug case before then you likely are eligible for drug court under prop. 36, but as to whether it will be offered is another story, and the reason why you need an experienced attorney right away.
