Legal Question in Criminal Law in California

three strikes law

my fiance is currently doing 7 to 8 years for ''robbery'' but it wasnt a robbery he shoplifted,he had no weapons of any kind,but he does have a record.the people got the stuff back,he wasnt given any of his time served when he went to prison which was the one year in the county jail,I thoght the three strikes was supposed to be for violent felons,this was not a violent case,is there anthing i can do?

Unfortunately, robbery is considered a violent/serious crime covered by the Three Strikes law. I do not believe there is anything you can do except perhaps for finding and hiring a good lawyer who might review his case and evaluate the validity of his conviction.

You can find an attorney who will look into the actual crime, and the trial, to check for errors made by the previous attorney. This however is not cheap. I am sorry that you have been given an answer previously that does not believe your story.
