Legal Question in Criminal Law in California
Subpenas
I filed a complaint against my boyfriend over six months ago due to domestic violence. We are still together and I tried to cancel my charges a long time ago but it was too late due past history. I just received a subpena, would I get in trouble not showing up? What will happen? I heard if I show up, he will automatically go to jail for one year. Can you please answer me by email as soon as possible. Thank you

Re: Subpenas
lIf you don't appear in court as ordered by the subpoena the court can and probably will issue a body attachment. That is an order that you are to be picked up the the sheriff or other law enforcement agency and held in jail until you testify incourt and the court releases you. If you lie in court you could be charged with conspiracy and sent to prison.
More importantly, why are you staying with an individual that has abused you and will probably abuse you again and again unless there is some sort of intervention. He needs some counseling hand help in overcoming this problem.
