Legal Question in Criminal Law in California
subpoena
Hi,I have a very rare question, I was issued a subpoena to appear in court, but it was served to me in another country, the subpoena is for CA and I was in mexico where the person who gave it to me is one of the defendants attorneys, is it a valid subpoena? Do I have to appear? And if I never get served do I still have to appear?
Thank you
Paul

Re: subpoena
Yes, it's valid. You probably have to appear, though I would need to know a lot more about your situation before I could be certain.
I'm not sure why you ask whether you need to appear if you "never get served". You have already been served and the plaintiff doesn't need to do anything further.
It's theoretically possible that the service was not carried out properly, but this seems unlikely -- especially since a lawyer did it personally.
