Legal Question in Criminal Law in California

Subpoena to testify in another state

I have been informed that I may be subpoenaed to testify in another state (California) for a fraud case, about which I have important information. This court appearance would be a very long drive for me. My questions are these: First of all, must I testify in the case if I do not wish to do so? and Second, I am having a difficult pregnancy that has made me quite ill. Is it possible to testify by videoconference or other electronic means at my local court system? Could my doctor write a note advising against me travelling to testify in the case?

Re: Subpoena to testify in another state

The district attorney in California can obtain a subpoena issued by the Nevada Court to compel your appearance at the trial.

Your best approach is to contact the district attorney that is having you subpoenaed to testify and explain your situation to him. Depending in the circumstances the trial may be continued until after the pregnancy or you are otherwise able to travel and testify.

The district attorney who is subpoening you should provide transportation. That is an airplane ticket, and hotel accomodations while you are there, if you have to stay overnight.

This reply is to supplement Lyle J. response.

Write the D. A. now, and let him/her know of your circumstances. Include a letter from your doctor. And if that isn't possible give the D. A your doctor's information so they may contact him/her.
