Legal Question in Criminal Law in California
Surrender for a Warrant
My 25 yr old son has a warrant out for his arrest for embezzelment - he did not return a rental car and passed bad checks. he is a meth addict-how should he surrender to the autorities - can he be in a drug treatment program when he surrenders? Will this help w/the penalty - he has contacted me for help but I can only talk w/him on the phone and occassionally help w/food. The police have tried to search my home w/o a warrant, waking me up at 1:30 am saying they were in hot pursuit of the stolen car. I allowed them in the garage and front entry but then asked them to leave and later contacted the sargent to tell him I did not know where my son was and I would talk to the police if they made an appt but I hoped they would not wake me up in the middle of the night again. They said my son had my address as his mailing address so that is why they came to my house but would not do so again,
thanks for your help - I am very scared for my son and not sure what to do.

Re: Surrender for a Warrant
Your son needs a lawyer *immediately*. He should have a lawyer help him surrender and represent him in the subsequent questioning as well as in court. Trying to do this without a lawyer is just asking for trouble.
If he can't afford a lawyer and you can't (or won't) provide one for him, he should contact the public defender in the county where the warrant was issued.
Your son needs to act immediately because the longer he waits the more likely it is that the police will find him. He will be much better off surrendering with a lawyer at his side than being captured without one.
