suspendened lincense

My Fiance and i were driving in san francisco, ca .a Police Officer pulled me over for not having a front lincense plate. I gave the officer my lincense and he stated that it was suspended. I told the officer that my fiance, which was in the passenger seat had a valid d.l and can driver the car, which is in her name, he stated that he has to impounnd the car..

Is there a question here? I'm not sure what your asking. If you are asking if the Police Officer has a choice about impounding the car?, I would tell you that depends on the Police Officer's department. California law gives the Police the right to impound an automobile when the driver is driving on a suspended license. However, in the field the officer is generally given discretion as to what offenses he is going to act on and those he will not act on. Since I do not know all the facts surrounding your incident I can not tell you if the Officer was justified or not. I can tell you unless his department has a policy of impounding vehicles he could have made a decision as impounding your vehicle or not. However, something could have provoked the officer and so he decided to ruin your day. Good Luck
