Legal Question in Criminal Law in California

i let a taxi driver hold my phone as collateral until i payed him. when i got it back he used it cuz there are numbers on here that i didnt call. And text messages in his language. What can i do about this.

Unfortunately, there is probably not a lot you can do. You could report this conduct to his company and whatever governmental agency regulates taxis in your area. I doubt if you have any legal claims that are worth pursuing because the monetary value of your damages is probably not going to be very much.

I just noticed that you posted this under criminal law. I suppose you could also report this to the police, but I doubt they would do much. If you do want to report it do not use 911, use the police department's non-emergency number.

How much did the driver's actions harm you? Do you think the driver was pretending to be you when he made those calls and sent those texts? Did he damage any of your personal or business relationships? Did he conduct business under your name? Did he cause your bill to be much higher than it otherwise would have been?

My sense is that none of these things happened, but I could be wrong. If you weren't harmed, then there isn't much point in either reporting him to the police or suing him. You can report him to the cab company and the local regulators as Mr. Kane suggests. But that is probably all you should do unless you can show some sort of harm caused by the driver's actions.

What can you do? Or what should you do? If the cost of the calls is less than the fare, he may have been assuming you were not going to pay him, and taking his payment in trade. Legal? Depends, did you tell him he could not make calls? Why would he hold the phone?

You are not a victim in this situation. Don't hire taxis without money to pay.
