Legal Question in Criminal Law in California

Theft of Helicopter Logbooks

A U.S. Citizen stole five (5) helicopter logbooks in Manila, Philippines. For this, a warrant for his arrest has been issued by a Philippine court. He however was able to leave the Philippines before the warrant can be enforced. Logbooks are the main documents vis-a-vis aircraft, the loss of which makes the aircraft practically worthless. We found out that this U.S. citizen has registered three helicopters using our logbooks.

1. Under what U.S. law/statute is he liable?

Re: Theft of Helicopter Logbooks

YOUR'S IS A VERY INTERESTING QUESTION. CERTAINLY THE ONE WHO TOOK THE LOG BOOKS IS GUILTY OF A CRIME IN THE PHILLIPINES FOR TAKING THE BOOK. HE IS ALOS GUILTY OF THE CRIME OF FRAUD IN THE US FOR THE HELICOPTERS SOLD TO OTHERS BASED ON FALSE LOGS--THERE ARE ALSO FAR VIOLATIONS AND FEDERAL PROSECUTION IS AVAILABLE. THE FBI SHOULD BE CONTACTED.

THE ISSUES IS THE RECOVERY OF THE LOGS. THIS IS A MORE DIFFICULT PROBLEM ON. WHILE YOU ARE ENTITLED TO THEM, THE ROAD TO THERE RETUTN MAY BE NEVE ENDING AND UNLESS THE THIEF CAN RESPOND IN DAMAGES, YOU MAY HAVE NO REMEDY EXCEPT, POSSIBLY, YOUR INSURANCE.
