That will depend on the county in which charges are brought, as well as the store from which the product was allegedly taken (some stores push harder for prosecution).

Depends on the County, the charges, the facts etc. You have already skipped to sentencing and she hasn't even been convicted or plead guilty. The second time around, however, can be bumped up to a felony. Therefore, while the instant charges appear minimal, in the long run, they may have huge implications. She needs an attorney.
