throwing gum

if one girl throws gum at another girl is this really a criminal offence?

As strange as it may seem, battery, as defined by section 242 of the Penal Code, covers any offensive or harmful touching. If there has been an arrest or prosecution, you can contact my office to discuss this further. There are certainly arguments that this is not a criminal offense.
