Legal Question in Criminal Law in California

Ticket stated several charges from a unauthorized search when he was there because of a dispute with neighbor that came on my property in a threatening manner accusing me of spraying her car. In defense of this angry person she did get sprayed officer came re her complaint then in middle if my Street twenty ft from my house he says he smells pot it wasn't from me or my house so in court when advised of charges it was pot my moms pills pipe then when pot lic and prescription for pills pub def says those were dropped and. All was left is pipe now since I said no to my pub def re probation all charges are back plus . taking it to jury trial is it legal adding charges like they are and who picks jury.

Why did you not take probation? You and your PD were negotiating a plea deal that drops charges in exchange for probation on others. If you tanked the plea deal they will try you on all charges.

Do you really want to take to trial? What if the unauthorized search turns out to be legal and they can admit the evidence. You then have all the charges and the jury could find you guilty.

Your PD probably had a good deal going...don't be so arrogant that you think you will beat the charges. Your time to challenge the search was when the cops wanted to search...

Both sides deal with jury selection...
