No attorney can foresee the ultimate outcome of the case , but you face the real potential of state prison time. Consult with a qualified attorney in or near your area and go over all the facts with the attorney. We give free phone consultations if you desire to call us. Best of luck...David Wallin

Your question depends on a lot of information you have not provided including the county you are in or where you were arrested. However, even with all the information an attorney can not give you any guarantees regarding the final outcome in any case. What I can tell you is that 11378 provides a very real possibility of State Prison time and that you need an attorney. I suggest you stop looking for answers on the internet and start consulting with some private attorneys. If you can not afford an attorney the Judge will appoint a public defender to your case at the arraignment. If you do not know how to start looking for attorneys, contact the local county bar association and ask them for referrals from their attorney referral list. You are looking for a criminal defense attorney.

Good luck,

Brian McGinity

I agree, you need a criminal defense attorney to review the facts of your case and your personal history ASAP. Because this is a second offense and you had to serve on your first offense, you may be looking at jail time again.
