Legal Question in Criminal Law in California

Time Constraints on motions

When a motion is filed with a court, in this case San Joaquin County, is there a limit on the time a court may take to respond to the motion in the form of a court date? For example, a motion was filed in October 2006. To date, December 11, 2006 a court date still has not been issued.

Re: Time Constraints on motions

I am unaware of any time limit for issuing a date for a hearing. Normally a court date is set on the day the motion is filed. I suspect that your motion was lost and will have to be refiled.
