First Time Offense
I took a watch from a friends house, when confronted i lied as i was embarrased to get caught. i had always fully intended to return it which is why i didn't get rid of it. but she reported it to the police. i was arrested on grand theft. i spent the day in jail and they have the watch. i go to court this week. will i go to jail?

grand larceny requires a showing of very specific elements of the law to be met in order for a proper conviction to be obtained by the prosecutor. the burden of proof to satisfy ALL elements of the crime you are being charged with is solely on the prosecutor, and you definitely appear to be able to defend one of the elements at least from the facts given so far. that element would be "the intent to steal the watch or deprive your friend of it permanently". this may be your best defense from the facts given so far, but there may be alot more areas you could challenge the charges based on additional facts being given by you to an attorney ASAP. if you would like further legal assistance and/or representation in this case, please email my Law Firm directly with additional facts asap and we can hopefully help ensure you get justice in this matter. thanks for your question.

Unfortunately, no attorney can guarantee that you will, or you will not, face jail time in a particular case. I can tell you that for grand theft in California, the maximum includes jail time. You may have other factors, however, including your absence of a criminal record, that can keep you from jail time, or convert any jail time offered to community service, house arrest, physical labor, weekends, or some other option. You may also have defenses, such as problems with proof, that may help you leverage a negotiation through an attorney defending on your behalf.
