Talking on the phone is just a ticket ($25 bucks I believe) but possession of weed is a misdemeanor which would go on your permanent criminal record if convicted. Having a marijuana conviction of any kind can be problematic down the line; for example, I have dealt with people who got denied federal student aid because of minor marijuana offenses.

A good lawyer should be able to keep your record clean. Feel free to contact me if you are looking to involved private counsel on this matter.

Using a cell phone (without a hands-free device) while driving is a moving violation, not a crime. Possession of marijuana, however, is criminal. It may even be a felony depending upon the amount. The fact that you got a ticket for it suggests that the charge against you is a misdemeanor.

You need a lawyer if you want any chance of beating the charge. Hire one if you can. Otherwise, get a public defender.
