Legal Question in Criminal Law in California
timely filing of motions before trial
At a retrial that the defendant won on appeal, can the defense still file a 995 motion? What motion can be filed to show the court at a retrial that the evidence is inadmissible? Especially, because the counsel before (first trial) did not pursue a motion to suppression of evidence. Is it too late?.This trial is over prop 215. Brian
