Legal Question in Criminal Law in California
trespassing
I need to know what is considered trespassing.
There was a promotional event at Edison Field in Anahiem for Halloween. There was free parking for the event on the grounds. So we were already on the property. Then we were short on money so we jumped a fence into the Halloween maze. Security did a citizen arrest and called the real cops. I was booked in at Anahiem PD, then Cited and released. I have a court date coming up. Is there any course of action,
do to the fact that I was invited to this event on their PROPERTY over the radio. So when I jumped the fence I was already on their property, and was not trespassing.

Re: trespassing
Thanks for your posting, and apologies for the length of time it took for you to get an answer.
The City Attorney of Anaheim prosecutes these cases out of the North Orange County Justice center in Fullerton, and they aggressively prosecute these, as well as "ticket reselling" cases out of the Pond, and other minor offenses.
If you were in an area of the event where you needed to pay to get in, they may try to state that you did not have permission (hence trespassing) and thus are guilty.
Commonly, though, the City Attorney will negotiate these down to more minor infractions if you have an attorney.
I hope this helps, and if you need legal representation, or have further questions, please feel free to call me anytime, toll free, at 1-877-568-2977, or email my office.
Re: trespassing
Unless there was a money charge to get in, or some security system you avoided by going over the fence. I suspect the D. A. will not file on your case.
So right now you don't really know what your legal position is, and you're wasting your and my time. Once you find out whether the D. A. (City Attorney) is going to file. Then ask your question.
