Legal Question in Criminal Law in California

Tresspassing Victim

I gave a verbal order to my ex girlfriend via the local police department not to enter my place of residence. Against that order, she entered anyway while the local PD 'detained' me. She took her dog but also clothing and $3,200 in cash. The police don't seem to have an interest in this. What can I do?

Victim of Trespass

Thank you for your posting and your inquiry.

When you state "what can I do"? I'm not clear if you mean against the police, since you mentioned that they did nothing, or against your girlfriend.

Trespass is an area of law that is both a crime, if prosecuted by the state, or a civil tort. You can sue, in small claims or otherwise, for any damages due to the trespass. You didn't describe what those damages might be, so I can't speculate on that, but you are entitled to receive compensation for proveable damages in court.

I hope that this information helps you, but if you have further questions, want more information, or feel that you need legal representation, please feel free to email me directly at [email protected]. It's my pleasure to assist in any way that I can.
