Legal Question in Criminal Law in California

Do I get in any trouble if I help her?

My ex-wife was convicted of having in her possession drugs to sell. She was sentenced to 2 years in a rehabilitation center for women. She will get out soon (completed only one year) She left 2 kids 12 and 14 years of age behind in the care of family members. She original came from an another country so because of her felony conviction she may face deportation. If that happens, she wants me to take her kids to the border to her. Her 14 year old one has gotten in trouble in school a lot. He has been taken to Juvenile hall several times so he may have some problems with the law too. In what king of legal trouble would I get into if I choose to take these kids to her out side the country? I thank you for any information you can give me. LUPE

It really depends on who has legal custody of the kids and/or if the juvenile court has taken jurisdiction over the kids. More likely than not, if you help your ex sneak her kids out of this country you could be committing a serious felony. You would be better off helping her by finding out what needs to be done via the legal system or the child welfare system to ensure that her children are reunited with her when she is release from prison. The priority should be to do what is best for her children and not necessarily just what she wants.
