Type your question here...Hello, my daughter and her best friend had had a falling out. Monday morning they went to school and her friend asked to be moved and said it was bugging her to set next to my daughter in front of the class. My daughter told her to stop it. The friend stood up and said what are you going to do about it my daughter stood up and started yelling back and forth with her. They got close and tried to slap each other the teacher got in between them and they were each reaching around the teacher yelling at each other they both went to slap each other and someone grabbed my daughters friends hand but my daughter slapped her friend not hard just brushed her face. Now both girls were suspended but because my daughter touched her she was arested for battery now over a month later I just got a letter saying my daughter has an probation appt? What is going on?

For juveniles, the probation department will be the first stage. They can decide to handle things informally and not refer the case to the DA's office for criminal prosecution. Or, depending on what happens, they can then send it to the DA for their review. Whether the DA files or not depends on the facts and what the DA thinks they can prove.

It may be worth it to sit down and consult with an attorney before the appointment to discuss the situation and how to get your daughter in the best position for a good outcome.
