Legal Question in Criminal Law in California

Undercover prostitution

I was arrested for loitering with the intent to prostitue in an undercover sting operation in 2007. The undercover officer was standing outside of a house when I approached him. He asked me how much again for sex, I said, ''huh what are you talking about, are you a police officer'', he said no, & we proceeded to the front door. He then acted like he was opening the door, then said is it okay if we f**k right her on the floor, I said, ''what'' & started to walk away. I was then placed under arrest for loitering w/intent to solicet prostitution. I heard that only a uniformed police officer could arrest someone on that charge? Is this true? Also during the interagation, I did admit to receiving money for sex in the past. Should I plead guilty or not guilty? I was also arrested for DUI in 1999.

Re: Undercover prostitution

It is not true that only a uniformed officer can arrest someone for prostitution (or for any other crime, for that matter).

You should not plead guilty unless you have a lawyer representing you and she recommends doing so. The case against you seems fairly weak, and there is a very good chance that you could win or at least negotiate a deal involving a plea to a lesser offense.

Do not try to represent yourself. Hire a lawyer if you can possibly afford one. Use the services of the public defender if you can't hire your own lawyer. A guilty plea will have consequences that will haunt you the rest of your life, and you should not simply accept them without at least trying to mount a defense.
