Legal Question in Criminal Law in California

Unlawful entry

The mother of our foster child entered our home at 2 am and removed her child. The state is dealing with that part of this incident. My question is: What charges can I file against her? There was not forceable entry, A door was unlocked. I also would like to obtain some legal method of keeping her away from my home. The child has been moved.

Even though your door was unlocked criminal charges may possibly be filed. You should notify the police about the incident immediately. In order to keep her away from your home you could ask the court to issue a temporary restraining order if you fear that she may come to your house again to cause injury or mischief.
