Legal Question in Criminal Law in California
Unlicenced Driver
I let my friend drive my car with me in it even though she has no licence. We got pulled over and the officer let us drive off without towing my car, taking us to jail or giving me (the licenced and insured driver) a ticket but he gave my friend who has no liscence a ticket. She has a court date for all of that; basically I'm worried that even though he let me go with nothing that I can still get a ticket, have my car towed, or have my insurance rates go up because of this. He did list my car on the ticket and he did give her a misdemeanor ticket. So should I be worried about being fine, jalied, or brought to vourt about this and possibly other consequences?

Re: Unlicenced Driver
In this situation, it is highly unlikely that you will suffer any consequences. You have no court date or ticket as you mentioned. Further, unless the person who was driving was a minor, who can prove that you knew he/she did not have a license? In these situations the law will almost always go after the driver only.
Depending upon practice of the prosecution and the court, your friend should be able to avoid misdemeanor conviction when he/she gets a license. The trick to the case might be to continue the case for as long as he/she needs to get it and show proof.

Re: Unlicensed Driver
You were very lucky that she was not in an accident. Never again entrust your car to anyone who is unlicensed, intoxicated, uninsured, or otherwise unfit to drive -- you could be liable in unlimited amounts for the damages caused.
