Legal Question in Criminal Law in California
Unpaid fines
My boyfriend (20 yrs old) was given a fine for (less than 28.5 grams)marijuana possesion. He did not have the money to pay. Appeared in court, he ask if he could serve the time in jail. But the judge said that it was too little of an offense for jail time and instead gave him community service. He did not do the service. He faced jail time. How long would he be serving time?

Re: Unpaid fines
The max fine in California for the offense you described is $100 plus a penalty assessment that can be as much as $150 extra. The factors for converting fines to community service to jail time vary depending on where you are. If you live in a place where the jails are very overcrowded, could be as little as a day. I would be surprised if more than 3 days anywhere in the state. For future reference, BF would have had nothing to lose by pleading not guilty and fighting the charge - all you can get is a $100 fine.
