Legal Question in Criminal Law in California
What can I do to get the unreasonable parole condition that prohibits my husband from living at home changed or removed?
1 Answer from Attorneys
Whether that parole condition is "unreasonable" depends on the crime your husband was convicted of, and on the evidence against him. The condition might be entirely reasonable -- or at least reasonable enough to be legal -- despite how you feel about it.
Your husband may be able to challenge his conditions of parole, depending on how long ago they were imposed, whether he has waived various rights, and what steps he may have taken in the meantime. Whether *you* can successfully challenge the conditions yourself is an interesting question. The answer is probably no, but that will depend on a variety of facts.
You and/or your husband may want to consult with a lawyer experienced in California criminal appeals and habeas cases. Feel free to contact me directly if you'd like to discuss your case in more detail. I have over 20 years of appellate experience, and am certified as an appellate specialist by the State Bar of California's Board of Legal Specialization. Whether I hear from you or not, good luck.
