Legal Question in Criminal Law in California
urine test at probation officers office
my brother was recently sentenced on a possession of paraphenalia charge and given probation. on his second visit to his probation officers office, they had him take a urine test. the p.o. told him he tested dirty for meth and marajuana, and arrested him. my brother had not ''used'' in over seven days, and has never been a pot smoker -......they sent his urine to the lab and he is now waiting to be masterbooked at county jail. my question is this; whatare the statistics on the accuracy of the urine tests given an the po office - the one where they use a dip stick, and to me, since they are inaccurate about the results of the dipstick test, how can we trust the lab will accurately handle the urine? Also, what are the chances the po will end up saying, ''Oh sorry - it looked like a dirty test to me?'' And then, how to hold him accountable???

Thank you for your email. Please call me at (800) 313-9619. I need to know some further information regarding this case. If there is a retained urine sample, for instance, it may be possible to have an independent lab test it.
