violate probation

My felony probation expires in may of this year. I was recently arrested in another county for possesion of controlled substance, which the da is charging as a felony. After 4 days in jail the judge gave me an o.r. release. If I understand the penal code correctly a person on felony probation is'nt entitled to an o.r. release. Does that mean the court was'nt aware of my probation status when granting an o.r. release? A 30 day continuance was granted for the prelim. Whats your advice on me filing a motion to terminate probation, in hope this current arrest won't result in a probation violation? And I have'nt informed the probation department of my current arrest although I'm required to do so within 72 hours after release from custody. Should I keep my mouth shut? Thanks.
