violation of court order

If I was ordered by the court to register in a drug diversion, and the deadline to register has already past, and now there is a warrant out for my arrest. What can I do to take care of this now.

Mr. Troy gave you some good information, and the first step is to recall the warrant. A warrant can only be recalled by either you, or an attorney appearing for you, stepping into court, and asking a judge to recall it.

Taking care of registering for the diversion now, as well as making sure that you are on track with paying your fines and other terms of your case, is an important first step.

The key in cases where there is a warrant is showing responsibility. Hiring an attorney shows responsibility, as the court knows you will have someone to guide you through the process so you will not miss future dates, and taking care of as much as you can shows responsibility to the court.

If possible, register for the diversion program immediately. You will have to go back to the court to get the warrant recalled no matter what you do. However, if you are in the program it will look better for you. CAUTION: If you choose to go to court yourself, you may be arrested and remanded. It is better to have a lawyer do this for you. Also, there is probably a probation officer or Deputy D.A. assigned to you for the purposes of overseeing your drug diversion progress. Contact that individual and tell them what is going on. You will have to be drug free when you start the program. They will suspect that the reason you failed to register is because you are still using. You may have to spend some time in jail if you fail a urine screen. In any event, the diversion program is better than a conviction. If you fail to do this, you will be set back on the path of facing the criminal charges. Talk with a criminal defense lawyer in your area to help get the warrant recalled.
