Legal Question in Criminal Law in California

violation of probation

If a term on probation is stricken in 6/08, yet is still being treated and charged on the persons record to this date. now this person is in jail serving 6 months for probation violation for 3 terms of probation, though 1 of them was stricken as of 6/08. Can this be a miss trial or something.

Re: violation of probation

I'm not clear on what you're asking. You were convicted of something, right? You were put on probation. You had certain terms of probation you had to comply with.

Somehow, you violated? If the violation is for a term that was stricken and not supposed to be enforced, then no - you should not have been violated.

You're being way too vague and looking for an answer. I assume you were represented by an attorney for the conviction (whether it was by plea or by trial). Discuss this with them.
