Violation of Probation

I am being violated by my probation officer for a dirty test.ITs my first violation.Do i qualify for prop 36 instead of 90 days in jail.I cant afford to lose my job.

It's impossible for me to advise you without knowing what you were convicted for (Penal Code Violation) and of (Felony or Misdemeanor). You should resubmit your question, and provide this information. You'll get better answers to your question. I don't believe you'll be eligble for a Prop 36 diversion. However, the judge would have the authority to require you to attend additional cousneling (like Prop 36) rather than send you for more jail time. The judge has wide discretion on matters of probation.
