Legal Question in Criminal Law in California
violation of probation
if someone violated probation for the second time and they are trying to sentence him for 16 months in state prison, is county time credited from state prison time? I also heard that if he has served 270 county then he can get out on parol, is this true?

Re: violation of probation
As a general rule county time including good time behavior is credited to the time in prison. However, if the time in county jail is for the offense that resulted in the probation violation, he would not receive credit for that time.
