Legal Question in Criminal Law in California
welfare fraud possible
Daughter applied for welfare and was
asked if she had children. She said she
had two. They did not ask if they were
living with her. They are with her 80%
of time. She received about $750 for 6
months. She just volunteered her
children were not with her. The worker
said this may be fraud, dc the money.
Is it? The payment were stopped. Is this
fraud since no one asked, according to
daughter, if the kids were living with
her. What should she do? Will she be
arrested?

She misrepresented the facts about the children being with her. She might be able to avoid prosecution, because of the confusion on her part. Often they do not prosecute cases such as this.
