will I do time

I took a friend to visit her dad in custody awaiting trial. When we arrived at the west valley detention center we were 3 minutes late so I parked as close as I could to to front door in a handicapped parking spot. I sent DMV form VA Hospital March 25,2003 for renewal. Because it was expired they asked if I had any weapons or narcotics in my truck, I said no except for a marine corp. K-Bar knife which was in my door in plain site where it has been since I bought my truck 2 yrs ago. I use it for cutting rope at the swap-meet. He told me to step out while he did a search, he then found a small amount of speed and 2 pipes.

You should review the specific facts of your case with an attorney. You should also investigate prop 36 treatment for you case. If you cannot afford to hire an attorney then you should request that an attorney be appointed to represent you.

Thank you for your posting and your inquiry.

You didn't mention what you were charged with, but I can think of about three separate potential charges. Each has a minimum and a maximum and would help in answering the question, "will I do time". Also, any priors you may have will be a big factor in whether or not you'll do time.

Typically, if the drugs are not alleged to be for sale or transportation, you may be eligible for a proposition 36, or pc 1000 class, which avoids jail time if this is succesfully completed.
