Will he get any time?

Hi, I was wondering if anybody would know for sure if my fiancee would get time. He has gotten in trouble for stealing a lap top and a watch. He has admited to it and was working with the detective. The detective was getting him out on OR which is a good thing. He was on informal probation because he picked up a bag from a grocery store that was left alone by the door. He just got community service and probation and fines. I am 7 months pregnant and we just got an apartment. So if he did go in, I would be in financial burden, because I would not be able to afford the apartment or bills with being on maternity leave. Can you give me some advice please?? Thank you!

It's almost impossible for any attorney to guarantee you an outcome that depends on factors out of our control - like a prosecutor, judge, or jury. In general, if they are charging him with a misdemeanor, the range is anywhere from probation to one year in jail. The fact that he was on probation and violated probation typically means that the sentencing will be more harsh, but a good attorney can present letters, documents, testimony, that will mitigate his sentence and allow him to fight the charges, or perhaps be eligible for alternative sentencing and avoid jail time.
