Legal Question in Criminal Law in California

Withholding the full story

My 5 month pregnant girlfriend and I were having a heated argument. She loses it and begins to hit, kick and slap me. I try to restrain her and she slams me into a wall. I completely lose it and I hit her multiple times in the face. As a result, the neighbors call the police and I flee the scene because I am already on parole. I tell her not to tell the police that she hit me because I fear that they would lock her up also. I already know my fate as a convicted felon still on parole but she is convinced if she tells them what really happened, she won't go to jail and they will have to drop the charges against me. The case has already been picked up by the district attorney's office. She wants to write a notarized letter explaining the events that occurred and send it to the DA's office. Will they charge her for domestic violence as well?

They just might. But that doesn't help your case. You hit her too. Your best choice would have been to leave. Too late now. Good luck.

Re: Withholding the full story

I have read Mr. Iadevaia's response to you, and I must tell you that I disagree with him completely. Your metters are complex and your vulnerabilities many. However, there are ways to maximize your resources given the current state of affairs. There are also ways NOT to make it worse in the future. For starters, neither you nor she should talk to any cops or prosecutors until you have consulted with an attorney. Most criminal attorneys give free consultations. Take one. Time is of the essence. I'd be happy to talk to you about these matters. If you'd like to do that, email me directly at [email protected]. Good luck. Steve Mandell
