Legal Question in Criminal Law in California

how does one get work furlough?

A friend of mine was arraigned for carrying a concealed weapon, the police ran the weapon's serial #'s and traced it back to something in another state. Since my friend bought the weapon on the black market he had no clue what had been done with the weapon before he got it and now was told he will be sentenced for 1 yr. From what i was told he has to turn himself in by a ceratin date this month. What i would like to know is what exactly is a work furlogh program? I have an idea but am not too sure. And how would someone go about ''applying'' for this program? Does it need to be done before a judge? before he turns himself in? Please help, if possible

Re: how does one get work furlough?

It seems as if some key facts may be missing - such as whether your friend was already convicted or if he was advised to plea to one year in prison... If he is still at the preliminary stages of the case, there may be more legal options available to him.

I would strongly advise speaking to competent counsel before agreeing to anything. One year in prison seems a bit excessive for the charge mentioned.

If you would like to contact me to discuss the case further, my number is 858.405.5881.

Re: how does one get work furlough?

Work Furlough probably varies from county to county. In Santa Clara county the application is made to the probation department. This application is most often made about 6 to 8 weeks prior to the commencement of the sentence. However, an application can be made while the person is in custody. The work furlough program is located in a separate facility which is separate from the jail facilities.

Aren't you skipping the part where Your Friend either pleads guilty or is convicted by a jury in a trial? Did a lawyer tell him to volunteer for a year in the slammer?? You haven't provided very many facts, but the sentence sounds excessive to me.
