Do you have to be convicted of a felony to go to prison, or will a misdomeanor send you to prison?

A misdemeanor can be punishable by a stretch in county jail which is No Fun. Or as Tom Bodett might say, when you're sleeping, county jail looks just like those big, fancy prisons.

The most that can happen to you on a misdemeanor is time in county jail and/or a fine. What the maximum time in jail is depends on what crime we're talking about.

Can you go to state prison for ONLY a misdemeanor? No. If you're on felony probation and pick up a new misdemeanor though, you can be found in violation and end up in prison on your prior case.

If you're asking if you can get locked up at all for a misdemeanor, the answer is yes. And because of that, talk to an attorney about your situation.
