Legal Question in Criminal Law in California
If someone writes a check to themselves, deposits it in a atm knowing there arent any funds, is it illegal? If so,what are the penalties? How should the situation be dealt with?

Depositing the check into his own account would probably be legal, but withdrawing the funds would not. There are a number of charges that he might face, depending upon the facts. There is also a range of penalties. I would need more facts before I could say what the most likely penalties would be.
