Legal Question in Criminal Law in California
wrongful arrest
My son was arrested & brought to court for not paying a ticket & ex-
spired license. Problem is they had the wrong name & arrested my son for no reason. He was exonerated We had to post bail which was $2,600 & now we want to get our money back. Who pays back the $2,600 (bail bondsman or the court)

Re: wrongful arrest
The court will refund the bail, but the refund will go to the bail bondsman who posted the money. He does not have to refund his fee to you, since he earned it by posting the bond.
