Wrongfully Searched??
A friend was driving my car when we were pulled over. My friend is on parole so we knew she would be searched and the car as well. However, after pulling her out of the car and handcuffing her (she had a warrent) the cop came to my side and asked me to step out of the car & asked if there was anything he should know about in the car winking at me saying you know what I'm talking about here right? I told him no there was nothing in the car & he could go ahead and check it out. I got out, and the female cop came behind me and began searching me. She did not ask to search me and when she did she found a pipe in my waist band. I was cited & released with a court date. My only charge was drug parafenailia. My question is this, did the cops have any right to search ME? I have never been in trouble & yes I do realize that since it was my friend driving they have the right to search her & the car she is opperating, but are the occupants subject to search w/out consent? The cop never even told us why we were pulled over. Can I fight the charge?

This is called a search incident to a lawful arrest. The officers were permitted to frisk you to see if you had any weapons; such searches are allowed because officers are often attacked during arrests.
Although the police are only allowed to look for weapons in such a search, they sometimes find other contraband and are not required to ignore what they find. The fact that they were looking for something else at the time doesn't matter.
Can you fight the charge? Sure. Can you win? I don't know, since you haven't provided all the information I would need in order to assess the case against you.
Evidence obtained in such searches is sometimes thrown out because the search went beyond what was reasonably necessary to check for weapons. For example, the officer would not have been allowed to make you open your mouth so she could look inside, since there was no reasonable chance that she would find a weapon there.
The same analysis may apply to the place where she found your pipe, but probably won't. The pipe was in your waist band, which is also good place to keep a knife. The officer probably was justified in searching there.
