Legal Question in Criminal Law in California
wrongly accused of sexual harassment
I work(ed) as a dispatcher for a messenger company. The airline has accused me of sexual harassment on five counts even though the employees are not pressing any charges against me. I had a fight with one of the female employees at one of the airlines who was yelling at me and calling me names because a peace of luggage had been delivered too late. I was trying to explain to her but she kept screaming like crazy until I couldnt take the abuse and yelled back at her If you dont shut up, I am going to kick your ass! She got a restraining order against me so I couldnt enter the airport. Then my boss told me that the company (the airline, our customer) is pressing sexual harassment charges with five counts against me and is sending the case to the DA. I got fired. I dont know if she is the only person that has made this complaint or if there are other people involved in this (five counts?). Up to the this incident I have always had friendly relationships with everyone, even to the employee who got a restraining order against me. My questions are: Will they arrest me or are they going to send me a letter? If there is no violence, can I be charged with a felony? Should I get a lawyer even though officially no one has told me anyt

Re: wrongly accused of sexual harassment
It's hard to know exactly what is going to happen, and there are many ways that this can unfold, but I think it would be in your best interests to consult with a lawyer now, rather than wait, so that you get some certainty about what will be happening and be able to control some of it. That way, you are not just picked up and whisked off to jail. You can be charged with a felony without any violence involved. Many felony charges do not involve violence. It sounds to me like early intervention is definitely in your best interests. if you'd like to discuss this with me, don't hesitate to contact me. Good luck. Steve Mandell
